Terms, Conditions and Disclaimers

These terms and conditions are relevant to all of The Rainmaker Institute’s events including live seminars, the Rainmaker Retreat workshop, teleseminars and webinars. For the purposes of this website, and since registrants usually only register for only one event at a time, all events and seminars will be referred to as the “Seminar.”

The health and safety of our attendees is our top priority. We have been actively monitoring the evolving situation related to the coronavirus (COVID-19). Our policies are designed to accommodate the needs of our attendees and we will continue to review them as the situation progresses. Should circumstances arise such that the attendee is prevented from participating in the Event as a direct result of mandatory government imposed travel restriction, and/or quarantine conditions imposed by governmental/local authorities, you will have the option to either receive a full refund or transfer the amount of the registration fee only to a future event. We are not responsible for and will not refund individual or corporate attendees for any other expenses related to your planned conference attendance. These expenses include, but are not limited to, transportation costs such as airline or train tickets and related fees, hotel reservations, or any other expenses.

By registering for the Seminar, you (the “Attendee”) signify your acceptance of and obligation to these terms and conditions. If you have any objections to the following Terms, Conditions and Disclaimers you should not register for or attend a Seminar.

Attendee Conduct

The Company requires all Attendees to be professional and respectful to our staff, location hosts, speakers, and other attendees throughout the Seminar, even during non-scheduled downtime and breaks. The Company reserves the right to ask the Attendee and/or their guests to leave the conference room and Seminar immediately should they be deemed rude, uncooperative, unprofessional, intoxicated or in possession of alcohol or any illegal substance. In such case, the Attendee’s tuition/fees for the Seminar will NOT be reimbursed under any circumstances and they will NOT receive any future products, services or correspondence from the Company. An Attendee who is asked to leave the Seminar will not receive any of the Company’s advertised bonuses or qualify for the Company’s satisfaction guarantee or any other written or implied guarantee.

Liability Waiver

While we take every possible measure to ensure safety of all Attendees at the Seminar, we cannot control every circumstance. The Attendee is legally responsible for their safety and any belongings and agrees to, and will be held legally liable for the following statements:

I, the willing Attendee of the Seminar, hereby accept all risk to my health and of my injury or death that may result from participating in the Seminar and I hereby release the Company, Stephen Fairley, and the Company’s officers, employees, interns, contractors, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Seminar, whether caused by negligence of the Company, its governing board, officers, employees, or representatives, or otherwise.  I further agree to indemnify and hold harmless the Company, Stephen Fairley and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Seminar. Under no circumstances will the Company or Stephen Fairley or their assigns be held liable for my injury or death or any loss or damage of my personal belongings resulting from my participation in the Seminar. Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the Seminar, I consent to such treatment. I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify the Company verbally and in writing if I am at any time injured prior to, during, or after the Seminar in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that the Company is not legally obligated to act on that information in any way or to providing any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Seminar that I will notify the Company in writing and that the Company retains the right to ask that I not participate in portions of or the entirety of the Seminar.

Liability Disclaimer: No Professional Advice

The information contained in or made available by the Company, Stephen Fairley, and the Company’s officers, employees, interns, contractors, sponsors, speakers, representatives, or any third-party during the Seminar or on their websites or services they provide cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, mental, financial, medical, psychological, legal ethics, or legal fields. The Company does not offer any professional personal, medical, financial, legal ethics, or general legal advice and none of the information contained in the Seminar should be confused as such advice. Neither the Company, Stephen Fairley nor their assigns, sponsors, speakers, partners, contractors or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages to the Attendee or the Attendee’s business, including economic loss, that may result from participation in the Seminar or from the use of, or the inability to use, the materials, information, or strategies communicated through the Seminar or any products or services provided pursuant to the Seminar, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will the Company or Stephen Fairley be liable for any special or consequential damages that result from Attendee’s participation in the Seminar.

To be clear: You, the Attendee, alone are responsible and accountable for your decisions, behaviors, actions and the results in your business and in your personal life, and by your participation in the Company’s Seminar, you agree not to attempt to hold us, the Company or Stephen Fairley, liable for any decisions, behaviors, actions or results that you make or experience in your business or in your personal life due to your participation in this Seminar at any time, under any circumstance.

Confidentiality and Non-Compete

Attendee hereby understands that the tools, processes, strategies, materials and information presented in the Seminar are confidential, copyrighted, and proprietary to the Company and agrees not to record, duplicate, distribute, teach or train from the Seminar materials in any manner whatsoever without the express written permission of the Company. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and the Company will pursue legal action and full damages if these terms are violated in order to protect its rights.

Adult Content

During our Seminar, we will discuss several adult topics relating to personal and professional growth. We may also occasionally use adult or profane language to emphasize a point or connect with or surprise the audience (though we will never be lewd, and we will always use tact and discretion in doing so). Participants who are uncomfortable with such topics or language should not attend the Seminar.

Audio/Visual Rules and Release

Attendees may not, under any circumstance, use any type of recording device to capture the information provided at the Seminar. No recording devices, photography or videography equipment is allowed in the Seminar room. By participating in the Seminar, Attendee understands that portions of the Seminar’s live events may be recorded in video and audio and/or captured in still and/or digital photographs by the Company. Attendee agrees that the Company and its assigns have the right and permission to use such recordings and photographs should they include Attendee’s name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Attendee. Attendee understands and agrees that all recordings from the Company’s events are the exclusive rights of the Company and Attendee does not ask for or expect compensation for the use of recordings or photographs in which Attendee appears or speaks. The Company owns all rights of any audio, video, and/or photograph captured during the Company’s Seminar or at any of the Company’s other live events.

Privacy Policy and Terms of Use

By visiting our event sites and participating in the Seminar, Attendees acknowledge and agree that they are subject to the Privacy Policies and Terms of Use of the promoter, which are listed at: http://www.RainmakerRetreat.com/terms

Cancellation Notice

  • Attendees may send a substitute Attendee at any time by providing reasonable advance notice to the Company. Attendees are responsible for their own travel expenses.
  • Refunds
    Refunds for the 2-Day Rainmaker Retreat Seminar will be made provided cancellation is made in writing and received via fax a minimum of fifteen (15) days prior to the scheduled Seminar. A $150 administrative fee will be charged for all refunds. The cancellation fee will be deducted directly from the refund.*  Cancellations must be in writing and faxed to 480-907-2029 Attention: Refund Request for Rainmaker Retreat.
     
    Exchanges

    *Rather than cancel their attendance completely, the registrant may switch to a future Rainmaker Retreat Date. The switch may be made at no charge up until 7 days prior to a Rainmaker Retreat. If the switch is made within the 7 day period preceding the Rainmaker Retreat, a $100 fee will be charged.

  • If the Company cancels a Seminar for any reason, Attendees will receive a refund for 100% of the fee they paid. The Company is not responsible for nor will it reimburse any travel expenses the Attendee has incurred in the event of a cancelled Seminar.
  • If the Company postpones or reschedules a Seminar for any reason and the Attendee is unable or unwilling to attend on the rescheduled date, the Attendee will receive a refund for 100% of the fee they paid.
  • The Company is not responsible for any loss or damage as a result of a substitution, alteration or cancellation, postponement or rescheduling of a Seminar. The Company shall assume no liability whatsoever in the event this Seminar is cancelled, rescheduled or postponed due to a fortuitous event, Act of God, unforeseen occurrence or any other event that renders performance of this Seminar impracticable, illegal or impossible. For purposes of this clause, a fortuitous event shall include, but not be limited to: war, fire, labor strike, extreme weather or other emergency.
  • Please note that while speakers and topics were confirmed at the time of publishing, circumstances beyond the control of the Company may necessitate substitutions, alterations or cancellations of the speakers and/or topics. As such, the Company reserves the right to alter or modify the advertised speakers and/or topics if necessary without any liability to the Attendees whatsoever. Any substitutions or alterations will be updated on the Company’s web page as soon as possible.

Earnings Disclaimer

We’ve taken every effort to ensure we accurately represent our Seminar and its potential to help Attendees grow your business. However, there is no guarantee that Attendees will earn any money using the techniques learned at the Seminar, and the Company does not purport this as a “get rich scheme.” Nothing on the Company’s websites or at our Seminar is a promise or guarantee of earnings! The Attendee’s level of success in attaining similar results discussed is dependent upon a number of factors including the Attendees skill, knowledge, ability, dedication, business savvy, network, and financial situation. Because these factors differ according to individuals, the Company cannot guarantee Attendee’s level of success, income level, or ability to earn revenue. The Attendee alone is responsible for their actions and the results achieved in their personal life and their business. Any forward-looking statements outlined on the Company’s websites or in our Seminar are simply expectations or forecasts for future potential, and thus are not guarantees or promises for actual performance. These statements are simply the Company’s opinion. As stipulated by FTC law, the Company makes no guarantees that Attendees will achieve any results from the ideas, strategies, tactics, tips, or models presented at the Seminar, and the Company offers no professional legal or financial advice.

Satisfaction Guarantee

As stated on the Company’s websites and in the associated marketing materials, the Company guarantees that Attendees will be 100% satisfied with the Seminar should they attend the entire Seminar. Satisfaction is defined as the Attendees belief that the Company has delivered on what has been promised in promoting the Seminar based on our Seminar registration websites. If Attendees are not satisfied at the conclusion of the Seminar after having attended the entire Seminar, they must notify a Company staff member who is at the Seminar in the manner described herein and the Company will refund the Attendee’s fee to the Seminar. Travel expenses including hotel, lodging, airfare, car rental, food, and associated travel expenses will not be reimbursed under any circumstance. Attendees who are not satisfied with the Seminar must, at the immediate conclusion of the Seminar, verbally notify one of the Company’s onsite staff members of their dissatisfaction. Unsatisfied Attendees must also turn in all of their course materials as well as their personal notes taken from the Seminar. In some cases an unsatisfied Attendee may be asked to submit a letter explaining their reasons for dissatisfaction. Any refunds will be made within 30 days of the Seminar. All refunds are at the sole discretion of the Company and all the Company’s decisions are final and legally binding. Any statements of dissatisfaction or requests for refunds received after 24 hours of the event will not qualify for this guarantee.

Note: A guarantee represents a promise about the quality of services delivered; if an Attendee never experienced the services (i.e. never attended the Seminar), the guarantee obviously does not apply. Furthermore, the guarantee cannot be substituted or confused with the Cancellation Policy.

Review and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Arizona. Attendee agrees that any dispute that arises out of or relates to these Terms, Conditions and Disclaimers will be resolved via legally binding arbitration in the State of Arizona at a time and location convenient to the Company. If any of these Terms, Conditions and Disclaimers are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions.
